Match support to the case
When should you get legal advice for California probate?
| Situation | Why it matters | What to do next |
|---|---|---|
| The estate is uncontested and the documents are clear | The case may be routine, but the forms, notice, deadlines, and estate work still need an owner. | Decide whether you want advice, representation, or the complete settlement handled. |
| The estate includes real estate, a business, or difficult tax work | Authority, valuation, a sale, or tax-sensitive decisions can change the petition and administration plan. | Bring ownership, loan, insurance, and recent tax records to the first review. |
| Documents are unclear, a creditor is pressing, or family members disagree | Rights and response deadlines may need attention before property is moved or money is distributed. | Preserve the records and ask licensed counsel to review the issue promptly. |
| The estate may be insolvent or litigation is possible | Payment priority, objections, evidence, and court strategy require legal advice. | Do not promise payment or distribution until counsel has reviewed the estate. |

What Alix is
How does Alix combine legal support with complete estate settlement?
Alix is a Done-for-You estate settlement service that manages the process from start to finish. A licensed attorney handles the legal work. Your Estate Settlement Specialist handles the accounts, property, creditors, taxes, records, transfers, and beneficiary communication that keep the estate moving outside court.
A traditional legal engagement may not include every call to a bank, insurer, mortgage servicer, tax professional, appraiser, or beneficiary. Alix gives the complete settlement one owner instead of leaving you to connect the work yourself.

Questions to answer before choosing probate help
Do I need a probate lawyer in California?
Not in every case. California permits an executor or administrator to represent themselves, but legal judgment becomes more important when documents are unclear, a deadline is close, the estate is insolvent, property or business interests are difficult, a creditor issue develops, or someone contests the case.
What does a California probate lawyer do?
A probate lawyer advises the executor or administrator, prepares or reviews petitions and legal notices, responds to court questions, appears at hearings, and handles disputes or court-required financial reports when needed. The engagement should state exactly which filings and hearings are included and which estate tasks remain with you.
How are ordinary probate attorney fees calculated in California?
Probate Code section 10810 uses 4% of the first $100,000, 3% of the next $100,000, 2% of the next $800,000, and lower percentages above $1 million. The calculation uses appraised probate value. Court-approved extraordinary legal work and other estate expenses sit outside the ordinary schedule.
Does Alix include probate legal support?
Yes. Alix manages estate settlement from start to finish and includes legal support. A licensed attorney handles legal advice, filings, notices, hearings, court-required financial reports, and other work that requires a lawyer.
What is a California certified probate specialist?
The State Bar of California certifies legal specialists who meet additional examination, experience, education, and peer or judicial evaluation requirements. Certification can be useful evidence of probate experience, but it is not the only measure of fit. Confirm active license status, relevant case experience, communication, staffing, and engagement scope.
Can I represent myself and still get legal advice?
Yes. A self-represented executor or administrator can pay for a consultation or limited legal help, subject to the attorney’s engagement terms. Before choosing that route, list every filing, deadline, account, property task, creditor issue, tax record, and beneficiary update you will still need to manage yourself.
