California small estates

California small estate affidavit, limits, and eligibility

For deaths on or after April 1, 2025, California’s current adjusted limit for the personal-property affidavit procedure is $208,850. Different limits and court procedures apply to a primary residence and other California real estate.

The date of death controls the limit. Eligibility also depends on what property is counted and whether a probate case is already open.

Questions worth answering

Questions that determine small-estate eligibility

What is the California small-estate limit in 2026?

For a person who died on or after April 1, 2025, the current adjusted maximum for the personal-property affidavit procedure is $208,850. A primary-residence petition and the affidavit for other California real estate use different maximums. The date of death and the statutory counting rules control the comparison.

How long must I wait to use a California small-estate affidavit?

At least 40 days must pass after death before using the personal-property affidavit procedure under Probate Code section 13100. Use the full date-of-death period and gather the required ownership, successor, valuation, and death records while you wait. Another transfer route may use a different process or timing rule.

Can the small-estate affidavit transfer a house?

The personal-property affidavit does not transfer California real estate. A qualifying primary residence may use a separate court petition, and other California land or buildings may use a different small-value procedure. Confirm the property type, ownership, appraised value, date-of-death limit, and required court or affidavit documents.

Does every asset count toward the California limit?

No. California law excludes certain property from the small-estate calculation, and the selected procedure determines what is counted. Review each account, vehicle, trust asset, beneficiary designation, jointly owned item, and California property separately. Attach the current DE-300 value sheet when the procedure requires it.

Why might a bank reject a California small-estate affidavit?

A bank may flag an incomplete waiting period, unsupported value calculation, unclear successor, missing death or ownership record, wrong transfer procedure, or use of the wrong affidavit format. Ask for the institution’s written requirements, correct the specific issue, and keep proof of every document submitted and response received.

Can I use a small-estate affidavit after probate has opened?

An open probate case can affect whether the personal-property affidavit route is available. Do not assume the affidavit can replace or bypass the existing case. Confirm the property involved, the current court status, the representative’s authority, and the applicable Probate Code conditions before presenting an affidavit to an institution.
