Florida Probate Forms and Letters of Administration

Florida probate forms sorted into opening, creditor, inventory, and closing stages

Florida does not use one universal probate form packet for every estate. The documents depend on the court procedure, the will, the proposed personal representative, the property, creditors, beneficiaries, and county requirements.

Letters of Administration are issued after the court appoints the personal representative. They are proof of authority, not the first form you file.

Florida terms: State law calls the court-appointed executor or administrator the personal representative. An interested person is someone whose rights may be affected by the case. Letters of Administration are the court papers showing that person has authority to act.

Proof of authority

What are Florida Letters of Administration?

Letters of Administration are the court-issued document showing that the personal representative has authority to act for the probate estate. Banks, brokers, insurers, title professionals, and other institutions may request a certified copy before they will release information or accept instructions.

Letters do not erase the duties attached to the role. The personal representative must protect property, follow court and notice requirements, keep records, address valid expenses and claims, and distribute property only when authorized.

Which forms are used for Florida summary administration?

Summary administration begins with a petition that states the statutory basis for the shorter procedure and identifies the property, debts, and people entitled to receive property. The petition and supporting documents must address the surviving spouse when applicable, the will, known creditors, exempt property, homestead, and proposed distribution.

Do not treat a generic online “small estate affidavit” as a substitute. Florida’s summary-administration and disposition-without-administration procedures have their own legal conditions and county filing requirements.

Review Florida small-estate options before choosing a form.

Local filing details

Why do Florida probate forms differ by county?

Florida statutes and probate rules apply statewide, but clerks and judicial circuits publish local checklists, cover sheets, e-filing instructions, proposed-order procedures, hearing practices, and payment details. Use the county with venue, then confirm the current instructions on that clerk and circuit’s official sites.

  1. Confirm the correct circuit court and probate division.
  2. Use the current statewide rule and form requirements.
  3. Check the county clerk’s filing method, fee total, copy rules, and contact information.
  4. Check the judicial circuit’s checklists, proposed-order process, and hearing instructions.
  5. Keep a filed copy and proof for every submission.

Common questions

Florida probate questions about forms

Where can I find Florida probate forms?

Start with the Florida Probate Rules and the official clerk and judicial circuit for the county with venue. The required documents depend on the proceeding and estate facts.

What are Letters of Administration in Florida?

They are court-issued proof that a personal representative has been appointed and has authority to act for the probate estate.

Can I download one Florida probate packet and file it myself?

There is no one packet for every estate. Formal, summary, and disposition proceedings require different documents, and formal administration usually requires a Florida attorney.

Does Florida have a small estate affidavit form?

Florida uses summary administration and disposition without administration. A generic affidavit may not satisfy either procedure.

Do Florida probate forms need to be notarized?

Some probate documents are verified, sworn, or notarized and others are signed by counsel or served on interested people. Follow the current rule and county instruction for each document.

Can Alix help with Florida probate paperwork?

Yes. Alix manages the broader estate process with legal support included. A licensed attorney handles the legal filings and advice.
