Florida Small Estate and Summary Administration

A simplified Florida estate path showing property, expenses, beneficiaries, and a court petition

Florida calls its main shorter probate process summary administration. It may be available when the estate meets the current $150,000 statutory value condition or when your loved one died more than two years ago.

Eligibility is not based on a quick total of everything your loved one owned. The statute controls which property is counted, and debts, homestead, exempt property, and beneficiary rights still matter.

Florida terms: State law calls the court-appointed executor or administrator the personal representative. An interested person is someone whose rights may be affected by the case. Letters of Administration are the court papers showing that person has authority to act.

Who qualifies for summary administration in Florida?

A court may use summary administration when the will does not require formal administration and either the value condition is met or the person has been dead for more than two years. For the value route, the probate estate must not exceed $150,000 after subtracting property the statute excludes from the calculation.

Use the Florida procedure

Is there a Florida small estate affidavit?

Florida does not use one general small-estate affidavit that lets every estate skip court. Summary administration is a court proceeding that ends with an order transferring property. Disposition without administration is a separate, narrower court procedure for limited nonexempt personal property tied to qualifying final expenses.

If a bank, vehicle office, or another institution gives you an affidavit, confirm the law and exact facts it covers. It may apply to a specific asset and may not settle the rest of the estate.

The narrowest route

When can disposition without administration apply?

Disposition without administration may apply when the estate has only limited nonexempt personal property and the value does not exceed qualifying funeral expenses and reasonable medical or hospital expenses from the last 60 days of the final illness. Exempt property is treated separately under the statute.

Bring itemized receipts, proof of payment, property records, the death certificate, the will if one exists, and a complete list of the property you want the court to transfer. The clerk or court can reject the route when the facts do not meet the statute.

From petition to order

How does Florida summary administration work?

  1. Confirm venue, the will, the two-year or value basis, and the people entitled to receive property.
  2. Identify every probate asset, debt, known creditor, exempt-property claim, homestead issue, and proposed distribution.
  3. Prepare the petition and supporting documents required by the Florida Probate Rules and the county.
  4. File with the circuit court and provide notice or joinder as required.
  5. Respond to court questions, creditor issues, or required corrections.
  6. Use the signed order to transfer the property identified in the order.

Common questions

Florida probate questions about small estates

What is the small estate limit in Florida in 2026?

For the value route to summary administration, the counted probate estate must not exceed $150,000 under the current statute. Property excluded by the statute is not handled by simply subtracting it without analysis.

Can an estate use summary administration after two years?

Yes. The statute provides a separate route when the person has been dead for more than two years, subject to the will and other requirements.

How long does summary administration take in Florida?

Florida does not guarantee a fixed timeline. Completeness, county procedure, creditor and homestead issues, court workload, and required corrections affect timing.

Do you need a lawyer for summary administration in Florida?

The representation rule and local practice depend on who files and the estate. Legal advice is especially important for homestead, creditor, intestacy, ownership, or conflict issues.

What is disposition without administration?

It is a narrow Florida court procedure for limited nonexempt personal property tied to qualifying funeral and final medical expenses. It is not a general shortcut for every small estate.

Does a Florida homestead count toward the $150,000 limit?

The statute excludes certain property from the summary-administration value calculation, but homestead status and transfer rights require a fact-specific review.
